New ordinance allows, regulates certain off-highway vehicles on city streets

The Roswell City Council in January adopted an ordinance that allows and regulates the use of certain recreational and utility off-highway vehicles on city-owned paved streets. The ordinance specifies the requirements for such vehicles being used on city streets.

Those requirements include the vehicle having a steering wheel, non-straddle seating and a maximum-speed capability greater than 35 mph. There are also requirements pertaining to the weight and dimensions of the vehicle, as well as to the engine size and vehicle identification number. These types of vehicles are also required to have one or more headlights and one or more taillights, brakes, mirrors and mufflers if they are used on city streets. Operators of such vehicles on city streets must be properly licensed and insured and must wear proper eye protection. If the operator is younger than 18, he or she must wear a legally compliant safety helmet. The operators of these off-road vehicles on city streets must obey all traffic laws, the same ones that all drivers must follow. However, the speed limit for recreational off-highway vehicles operated in the city is restricted to 45 mph or the posted speed limit, whichever is less.

The city ordinance allowing compliant off-road vehicles to drive on city streets applies only to city-owned streets. It does not apply to state highways and other thoroughfares that may pass through the city, but are regulated and maintained by entities other than the city. Those streets that belong to an entity other than the city include, but are not limited to Main Street and Second Street.

Anyone who intends to use a compliant off-highway vehicle on a city street must obtain a special license-plate sticker from the New Mexico Motor Vehicle Division.
